Hamilton reckless homicide

trial ends in acquittal

By Linda Carmicle
Staff Writer

A man on trial for reckless homicide was freed Monday when he was acquitted due to insufficient evidence for a conviction.
Derrick Hamilton of Yosemite sat quietly in Casey Circuit Court as his attorney, Ted Lavit of Lebanon, made a motion for Judge James G. Weddle to acquit his client. Lavit said there was no further need to continue with the trial, due to the lack of evidence that Hamilton's recklessness caused the death of a teenage girl last summer.
If convicted, Hamilton would have faced not less than one year, but no more than five years.
Hamilton was indicted by a Casey County grand jury in January for causing the death of Venessa

Kemarly, 14, who rode her bicycle into the path of Hamilton's car on Aug. 20, 2005.
